Temple Carpet Cleaners Terms and Conditions

These Terms and Conditions set out the basis on which Temple Carpet Cleaners provides carpet, upholstery, and related cleaning services to customers in the United Kingdom. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the individual, company, or organisation requesting the services of Temple Carpet Cleaners.

Temple Carpet Cleaners means the cleaning service provider operating under the trading name Temple Carpet Cleaners.

Services means any carpet cleaning, rug cleaning, upholstery cleaning, stain removal, odour treatment, or related cleaning work provided by Temple Carpet Cleaners.

Premises means the property, building, or location where the services are to be carried out.

Agreement means the legally binding contract between the Customer and Temple Carpet Cleaners, comprising these Terms and Conditions and any written or verbal confirmation of booking.

2. Scope of Services

Temple Carpet Cleaners provides professional carpet and upholstery cleaning services, which may include vacuuming, hot water extraction, low-moisture cleaning, spot treatment, stain removal, odour neutralisation, and related tasks agreed with the Customer at the time of booking.

The exact scope of work will be confirmed during the booking process or on arrival at the Premises, taking into account the condition of the items to be cleaned, access, and any health and safety considerations.

Temple Carpet Cleaners reserves the right to decline specific tasks where it is unsafe, not reasonably practicable, or where the Customer has not provided accurate information about the Premises or items to be cleaned.

3. Booking Process

3.1 Bookings can be made by the Customer through any authorised communication method accepted by Temple Carpet Cleaners at the time, such as online forms or written correspondence. The Customer is responsible for providing accurate and complete information when making a booking.

3.2 A booking is deemed an offer by the Customer to purchase services in accordance with these Terms and Conditions. Temple Carpet Cleaners reserves the right to accept or reject any booking at its sole discretion.

3.3 An Agreement comes into effect when Temple Carpet Cleaners confirms the booking, either in writing or verbally, providing the date, approximate time window, and scope of services.

3.4 The Customer must ensure that either they or an authorised representative over the age of 18 is present at the Premises at the agreed time to provide access and confirm the work to be carried out.

3.5 Any time or date given for the commencement or completion of services is an estimate only. While Temple Carpet Cleaners aims to arrive within the agreed time window, it will not be liable for any loss or inconvenience caused by delays due to traffic, weather, previous jobs overrunning, or other circumstances beyond its reasonable control. Where possible, the Customer will be notified of any significant delay.

4. Access to Premises and Customer Obligations

4.1 The Customer must provide safe and reasonable access to the Premises, including suitable parking where possible, so that equipment and materials can be transported safely.

4.2 The Customer is responsible for ensuring that:

a. All areas to be cleaned are reasonably clear of small items, fragile objects, personal belongings, and valuables.

b. Any known stains, spillages, or areas of particular concern are pointed out to the cleaning technician before work starts.

c. The Premises has adequate electricity, water supply, and lighting for the services to be performed.

4.3 Temple Carpet Cleaners will not be responsible for moving heavy furniture, electrical appliances, or other large items unless this has been expressly agreed in advance. Where items are moved, they will be handled with reasonable care, but the Customer accepts that some items may remain in place and the cleaning may be limited to accessible areas only.

4.4 The Customer must ensure that children and pets are kept away from work areas, equipment, and cleaning solutions during and immediately after the service, particularly while carpets and upholstery remain damp or while machinery is in operation.

5. Prices, Estimates, and Quotes

5.1 Prices for services may be provided as a fixed quotation or as an estimate based on information supplied by the Customer. All prices are stated in pounds sterling unless otherwise specified.

5.2 Where a price is given as an estimate, the final price may vary depending on the actual size, condition, or nature of the items to be cleaned, or if additional work is requested by the Customer on the day.

5.3 Temple Carpet Cleaners reserves the right to revise a quotation or estimate if:

a. The information provided by the Customer was incomplete or inaccurate.

b. The Customer requests additional or different services.

c. Additional work is necessary due to unforeseen circumstances at the Premises.

5.4 Any change in price will be explained to the Customer before additional work is carried out, and the Customer will have the opportunity to accept or decline the revised price.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due immediately on completion of the services at the Premises.

6.2 Temple Carpet Cleaners may accept a range of payment methods, which may include cash, card payments, or bank transfer, subject to availability and any applicable conditions communicated to the Customer in advance.

6.3 For commercial or account customers, alternative payment terms may be agreed in writing. Invoices issued under such arrangements must be paid in full by the due date stated on the invoice.

6.4 If payment is not received on the due date, Temple Carpet Cleaners reserves the right to charge interest on the overdue amount at the statutory rate allowable under UK law and to recover any reasonable costs incurred in pursuing the debt, including administrative and legal expenses.

6.5 Temple Carpet Cleaners retains ownership of any consumable materials or equipment provided until payment has been received in full, although this does not permit the Customer to withhold payment for services already rendered.

7. Cancellations, Rescheduling, and No-Show

7.1 The Customer may cancel or request to reschedule a booking by giving as much notice as possible. Cancellations must be communicated using an accepted method of contact as specified by Temple Carpet Cleaners at the time of booking.

7.2 Temple Carpet Cleaners may apply a cancellation fee where a booking is cancelled or substantially amended with short notice. As a general guideline, same-day cancellations or cancellations within a short period of the scheduled visit may be charged up to a reasonable proportion of the quoted price, reflecting lost time and travel costs.

7.3 If the Customer is not present at the Premises at the agreed time and has not arranged suitable access, this may be treated as a late cancellation, and a call-out or cancellation charge may be applied.

7.4 Temple Carpet Cleaners reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to staff illness, equipment failure, adverse weather, or access issues. In such cases, the Customer will be offered an alternative appointment at the earliest reasonable opportunity. Temple Carpet Cleaners will not be liable for any loss arising from such cancellations or delays.

8. Condition of Carpets and Results

8.1 Temple Carpet Cleaners will use reasonable skill and care to deliver services and will select appropriate cleaning methods and solutions for the items in question, based on the information available and the professional judgement of the cleaning technician.

8.2 The Customer acknowledges that:

a. Some stains, odours, and marks may be permanent and cannot be fully removed.

b. Results will vary depending on the age, fibre type, previous cleaning methods, and level of soiling of the carpet or upholstery.

c. Pre-existing damage, wear, fading, and discolouration may become more apparent after cleaning.

8.3 Unless specifically agreed otherwise in writing, Temple Carpet Cleaners does not guarantee complete stain removal or restoration to a like-new appearance.

9. Customer Property and Damage

9.1 Temple Carpet Cleaners will take reasonable care to avoid damage to carpets, rugs, upholstery, furniture, and the Premises. However, the Customer should remove or secure fragile items and valuables prior to the visit.

9.2 If damage is caused by the negligence or breach of duty of Temple Carpet Cleaners, it will, at its option:

a. Repair the damage, or

b. Arrange for the damaged item to be repaired or restored, or

c. Provide fair compensation, taking into account the age and condition of the item.

9.3 The Customer must notify Temple Carpet Cleaners of any alleged damage or issue as soon as reasonably practicable and in any event within a reasonable period after completion of the services, giving full details and allowing inspection if required.

9.4 Temple Carpet Cleaners will not be held liable for:

a. Pre-existing damage, defects, or wear and tear.

b. Shrinkage, colour run, or texture changes where industry-standard cleaning methods have been used in line with the item type and condition.

c. Damage arising from failure by the Customer to follow advice or aftercare instructions provided, including recommendations regarding drying time and ventilation.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

10.2 Subject to the above, Temple Carpet Cleaners will not be liable for:

a. Loss of profit, business, revenue, or goodwill.

b. Indirect or consequential loss or damage.

c. Loss arising from delays, cancellations, or inability to perform services due to events beyond its reasonable control.

10.3 The total liability of Temple Carpet Cleaners arising out of or in connection with any single event or series of connected events shall, to the fullest extent permitted by law, be limited to the total price paid or payable by the Customer for the specific services giving rise to the claim.

11. Health, Safety, and Environmental Considerations

11.1 Temple Carpet Cleaners will perform services in accordance with applicable health and safety requirements and will use cleaning products and equipment in line with manufacturer instructions and industry practice.

11.2 Certain cleaning solutions and processes may carry risks if misused. The Customer must follow any safety or aftercare advice provided, such as keeping children and pets away from treated areas until fully dry.

11.3 Where reasonably practicable, Temple Carpet Cleaners seeks to minimise any adverse environmental impact by using appropriate products, equipment, and procedures.

12. Waste Handling and UK Waste Regulations

12.1 Temple Carpet Cleaners will handle and dispose of waste generated during the cleaning process in accordance with applicable UK waste and environmental regulations as they relate to its activities.

12.2 Standard household waste, such as vacuumed dry soil or small amounts of extracted dirt and moisture, will normally be left on site for disposal through the Customer's usual household or commercial waste system, unless otherwise agreed.

12.3 Where services result in the generation of waste that must be managed under specific regulations, such as certain contaminated materials, Temple Carpet Cleaners will either:

a. Manage that waste in accordance with relevant UK requirements, or

b. Notify the Customer that specialist disposal is required and agree appropriate arrangements. Additional charges may apply where specialist handling or removal is necessary.

12.4 The Customer must not request or require Temple Carpet Cleaners to dispose of waste in a way that breaches local or national waste management laws. Temple Carpet Cleaners reserves the right to refuse any request that would result in unlawful or unsafe handling or disposal of materials.

13. Complaints and Service Issues

13.1 Temple Carpet Cleaners aims to provide a professional and reliable service. If the Customer is dissatisfied with any aspect of the service, they should raise the matter as soon as possible, specifying the nature of the concern and the area or item affected.

13.2 Where a complaint is made within a reasonable time after completion of the service and it is agreed that the standard of work has fallen below what is reasonably expected, Temple Carpet Cleaners may, at its discretion:

a. Revisit the Premises to re-clean the affected area where feasible, or

b. Offer a partial refund or price adjustment, or

c. Take any other reasonable steps to resolve the issue.

14. Privacy and Data Protection

14.1 Temple Carpet Cleaners will collect and process personal data in order to manage bookings, provide services, and handle payments and customer communications.

14.2 Personal data will be handled in accordance with applicable UK data protection laws. Information will not be sold to third parties. It may be shared with trusted partners and service providers where necessary to deliver the services or manage the business, subject to appropriate safeguards.

15. Changes to Terms and Conditions

15.1 Temple Carpet Cleaners may update or amend these Terms and Conditions from time to time to reflect changes in law, practice, or service offerings.

15.2 The version of the Terms and Conditions in force at the time of the Customer's booking will apply to that particular Agreement. Any subsequent changes will not affect existing bookings unless required by law or with the Customer's consent.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by Temple Carpet Cleaners to exercise any right or remedy shall constitute a waiver of that or any other right or remedy.

17.3 The Customer may not transfer or assign any of their rights or obligations under these Terms and Conditions without the prior written consent of Temple Carpet Cleaners. Temple Carpet Cleaners may transfer its rights and obligations to another suitably qualified provider or legal entity where this does not materially affect the standard of service.

17.4 These Terms and Conditions, together with any confirmed booking details, represent the entire agreement between the parties in relation to the services provided and supersede any prior discussions, correspondence, or understandings.
